This Privacy Policy explains how Republic Clothing Apparel Inc., d/b/a JANE + MERCER ("JANE + MERCER," "we," "us," or "our") collects, uses, discloses, and otherwise processes personal information.
It applies when you visit janeandmercer.com or another website or digital service that links to this Policy; visit or interact with one of our retail stores, pop-ups, or events; sign up for or receive our email or text messages; communicate with us; or otherwise interact with JANE + MERCER (collectively, the "Services"). It is designed to cover our current stores and future JANE + MERCER locations.
In short: The information we collect depends on how you interact with us. We use it to operate and improve our business, communicate with you, market our products and stores, measure online and in-store activity, and protect our customers, personnel, property, and Services.
Personal information we collect
Depending on your interactions with us, we may collect the following categories of personal information:
- Identifiers and contact information, such as your name, email address, postal address, telephone number, account or customer number, online identifiers, IP address, and similar identifiers.
- Transaction and payment information, such as products viewed or purchased, order and return details, payment method and payment confirmation, billing and shipping information, and related records. Payment card information is generally processed by our payment providers rather than stored directly by us.
- Account, preference, and relationship information, such as account credentials, saved preferences, sizes, wish lists, store or product interests, survey responses, and, if offered, loyalty or rewards membership and activity.
- Communications and content, such as messages, customer-service requests, reviews, survey responses, contest or promotion entries, and information you choose to provide in forms or search features.
- SMS program information, such as your mobile number, opt-in and opt-out status, the date, time, source, and language of your consent, messages sent or received, and related delivery and engagement information.
- Device, internet, and network activity, such as device and browser type, operating system, unique device identifiers, cookie or pixel identifiers, referring and exit pages, pages viewed, links clicked, dates and times of visits, approximate location derived from IP address, and information about interactions with our websites, forms, advertisements, and messages.
- In-store information, such as images or video footage, timestamps, visit and traffic information, and information derived from security cameras and traffic-analytics systems, including RetailNext systems. Depending on system configuration, this may include traffic counts or information about movement through a store.
- Inferences, such as likely interests or preferences derived from the information described above.
- Sensitive personal information, such as account log-in credentials or payment-card information, when we need it to provide requested services, secure accounts, or process transactions. We do not use sensitive personal information to infer characteristics about you.
Sources of personal information
We may collect personal information from:
- You, including when you visit a store, submit a form, sign up for communications, make or attempt a purchase, return an item, enter a promotion, or contact us.
- Your browser, device, or activity, through cookies, pixels, tags, scripts, server logs, and similar technologies.
- Service providers and business partners, including Shopify, Klaviyo, Google services (such as Google Ads, Google Merchant Center, and Google Business Profile), Meta services (such as Facebook and Instagram), AfterShip, payment processors, point-of-sale and commerce providers, analytics and advertising providers, social platforms, fraud-prevention providers, RetailNext and other in-store technology providers, and vendors that support our operations.
- Our affiliates and corporate group, where permitted by law.
- Publicly available or third-party sources, such as public social-media profiles or joint promotion partners, when permitted by law.
How we use personal information
We may use personal information to:
- Provide, operate, maintain, and improve the Services and our stores, including accounts, purchases, payments, fulfillment, returns, customer service, and any loyalty or rewards program we may offer.
- Communicate with you about requests, transactions, store information, policy changes, and other service-related matters.
- Send email, SMS/MMS, direct-mail, and other marketing where permitted by law and consistent with your choices.
- Personalize content, offers, and advertising; understand interests; measure campaign performance; and conduct analytics and research.
- Understand store visits and traffic, improve store layout and staffing, and evaluate store and merchandising performance.
- Maintain safety and security, deter and investigate theft or fraud, protect people and property, enforce our policies, and preserve evidence.
- Debug, detect, prevent, and address errors, security incidents, malicious activity, and technical problems.
- Comply with law, legal process, and regulatory obligations; establish, exercise, or defend legal claims; and support corporate transactions.
- Carry out other purposes that we disclose at the time of collection or with your direction or consent.
How we disclose personal information
We may disclose personal information to the following categories of recipients for the purposes described above:
- Shopify. Shopify hosts and supports our website and may process information about your access to and use of the Services. When Shopify Network Intelligence is enabled, Shopify may use information from our store together with information from other merchants to provide enhanced services, such as analytics, personalization, fraud prevention, and advertising-related features, subject to applicable privacy choices. - Service providers and contractors. These include vendors that provide hosting, commerce, point-of-sale, payment, fulfillment, communications, customer support, cloud storage, data analytics, security, fraud prevention, professional, and operational services.
- Klaviyo and messaging providers. We use Klaviyo to manage email and SMS/MMS communications. We disclose SMS Data only as described in the SMS Data section below.
- Analytics and advertising partners. We use or may use analytics, advertising, social-media, and product-listing services provided by companies such as Google and Meta to understand use of the Services, manage product listings, measure advertising, and present or evaluate advertising on our Services and elsewhere. These providers may collect or receive device, browser, interaction, conversion, and similar information when their services are enabled or when you interact with our advertisements or social-media pages. Where permitted by law, we may disclose hashed contact information, such as email addresses, to advertising platforms to create matched audiences, suppress existing customers, or measure advertising. Depending on applicable law, some of these disclosures may be considered a "sale," "sharing," or use for targeted advertising even though we do not sell personal information for money. The advertising and audience-matching disclosures in this paragraph do not apply to SMS Data described below.
- In-store security and analytics providers. These include RetailNext and other vendors that support video security, loss prevention, traffic measurement, and store operations.
- Affiliates and corporate group members, for legitimate business and operational purposes.
- Government authorities and other parties for legal, safety, or enforcement purposes, when we believe disclosure is appropriate to comply with law or legal process, protect rights or safety, investigate misconduct, or enforce agreements.
- Parties to a business transaction, such as an actual or prospective merger, financing, sale, reorganization, bankruptcy, or transfer of all or part of our business or assets.
- Other parties at your direction or with your consent.
SMS Data is not shared for marketing
Mobile numbers, SMS opt-in and opt-out data, consent information, message data, and related information collected in connection with our SMS program ("SMS Data") will not be sold, rented, or shared with third parties or affiliates for marketing or promotional purposes. We may disclose SMS Data to Klaviyo, telecommunications carriers, aggregators, platform providers, and other service providers solely as necessary to operate, support, secure, and administer the SMS program; comply with law; or honor your directions. The advertising and audience-matching disclosures in this Policy do not apply to SMS Data.
Cookies and similar technologies
We and our providers may use cookies, pixels, tags, web beacons, scripts, local storage, and similar technologies to operate the website; remember settings; understand how visitors use the website; measure communications and advertising; detect fraud; and personalize content or advertising. These technologies may collect or transmit information such as page URLs, referring pages, device and browser information, identifiers, pages viewed, links clicked, and information you submit through forms or search features.
Your cookie choices
You can use the cookie banner or the "Manage Preferences" control on our website to accept, decline, or customize nonessential technologies. Where required by law or reflected in our settings, nonessential analytics and advertising technologies are used only after you make the applicable choice. You can also adjust your browser settings, but blocking some technologies may affect website functionality. Your choices may be browser- and device-specific and may need to be renewed if you clear cookies or use another device.
Opting out of sale, sharing, or targeted advertising
Depending on where you live, you may opt out by using our Do Not Sell or Share My Personal Information page or the applicable cookie-preference control. We also process Global Privacy Control (GPC) signals as requests to opt out for the browser or device sending the signal where required by law. We do not respond to other browser "Do Not Track" signals.
Email and SMS/MMS marketing choices
You may unsubscribe from promotional emails by using the unsubscribe link in an email. If you opt in to JANE + MERCER promotional text messages, message frequency varies and message and data rates may apply. Consent is not a condition of purchase. We may retain a limited record of an unsubscribe or opt-out request so that we can honor it. Opting out of one channel does not automatically opt you out of another channel.
U.S. state privacy rights
Depending on where you live and subject to applicable exceptions, you may have the right to request access to or a copy of personal information we maintain about you; request correction or deletion; obtain data portability; opt out of sale, sharing, or targeted advertising; limit certain uses of sensitive personal information; withdraw consent where processing is based on consent; and appeal a decision on a privacy request. You also have the right not to receive discriminatory treatment for exercising applicable rights.

We may need to verify your identity and residency before acting on a request. We will use information provided for verification only for verification and request-processing purposes. An authorized agent may submit a request where permitted by law, but we may require proof of authorization and direct verification from you. If we deny a request, you may appeal by replying to our decision or emailing us with the subject line "Privacy Appeal."
Retention
We retain personal information only for as long as reasonably necessary for the purposes described in this Policy, including:
- Contact, account, preference, and customer-relationship information for as long as the relationship remains active and afterward as reasonably needed for support, recordkeeping, and legal obligations.
- Transaction and payment records for the periods required for tax, accounting, fraud prevention, warranty, dispute, and legal purposes.
- Marketing preferences until you opt out, plus a limited suppression record afterward so that we can honor the opt-out.
- SMS consent, opt-out, and messaging records for as long as reasonably needed to operate the program, demonstrate compliance, resolve disputes, and meet legal obligations.
- Security video and related in-store footage for a limited period consistent with security, loss-prevention, operational, and legal needs, with longer retention when an incident, investigation, dispute, preservation duty, or legal requirement applies.
- Cookie, device, analytics, and advertising information according to the lifespan of the applicable technology and our operational, consent, and legal needs.
When deciding a retention period, we consider the nature and sensitivity of the information, the purposes for which it was collected, the risk of harm from unauthorized use or disclosure, and applicable legal, accounting, and contractual requirements.
Security
We use administrative, technical, and physical safeguards designed to protect personal information. No security measure or transmission is completely secure, however, and we cannot guarantee absolute security. Please do not send sensitive or confidential information through unsecured channels.
Children
The Services are not directed to children under 13, and we do not knowingly collect personal information online from children under 13. If you believe a child has provided personal information to us, contact us so that we can review and address the matter.
Third-party services and links
The Services may link to or integrate with websites, applications, social platforms, or services controlled by third parties. Their privacy practices are governed by their own notices, not this Policy.
International processing
We and our providers may process personal information in the United States and other countries, which may have different data-protection laws from your location. Where required, we use appropriate safeguards for international transfers.
Changes to this Policy
We may update this Policy to reflect changes to our practices, technologies, Services, or legal obligations. We will post the revised Policy and update the "Last updated" date. We will provide additional notice when required by law.
